and he is probably paying for everything because he feels guilty for hurting you like that and treating you the way he did.  

well, talk to him end of the month before filing the divorce, give him a deadline... he may get more motivated to make a decision one way or the other if there's a deadline for something.

i'm no lawyer... and i dont know where i heard it... and pending which country (law system) u're in and everything...
but when it comes to mortgages, there could be a possibility that if one party shows that they've made most of the payments, they could be entitled to the asset.

however, theres a sky high probability that i'm dead wrong about this
